89-8 to avoid tax hikes for 99% of all americans. >> this shouldn't be the model for how we do things around here but i think we can say we've done some good for the country. >> reporter: if the bill eventually becomes law, the bush-era tax cuts will be permanently extended for everyone making less than $400,000 a year. and families making less than $450,000 a year. it will also keep the alternative minimum tax for the wealthy from hitting millions of middle class families. >> middle class families will wake up today to the assurance that their taxes won't go up $2,200 each. >> reporter: the senate agreement delays $110 billion in spending cuts that were due to kick in today for another two months but because the bill doesn't address spending getting it passed in the house could be tougher. >> the fact that the president won't challenge has party on spending cuts is disgustingching the fact that we're not where we need to be

on revenue is disgusting. >> reporter: president obama wanted a bargain that dealt with taxes and spending cuts at the same time. >> but with this congress, that was obviously a little too much to hope for at this time. >> reporter: house speaker john boehner has not yet publicly endorsed the deal. and the house reconvenes by midday today. a vote could also come today. >> tara, a lot of republicans weren't happy with the president's speech yesterday. is there any indication that that could affect the vote in the house? >> well, president obama during that speech criticized congress for taking too long to come up with this deal. he also laid the groundwork for another problem that's coming and that's basically burrough -- upping the country's burrough limit. republicans will no doubt try to use upping that in ex-kang for spending cuts. and to which the president said, they have another thing

coming if they think that's going to be the case. spending cuts alone are not going to be able to reduce the country's deficit. so we have that coming. senator john mccain said basically that's going to antagonize a lot of the house members and possibly jeopardize the vote. >> a lot of negotiations still need to be done. all right, tara mergener live in washington for us, thank you. what a night! the weather cooperated for a spectacular night of fireworks along the waterfront right here in san francisco. beautiful view, big crowds jamming the embarcadero. when it was over the cars jammed all the streets in the area. everyone had to go home. although many are still here. new year's celebration was not 100% peaceful though. cbs 5 reporter cate caugiran here in san francisco where at least three revelers were wounded in shootings during the festivities. good morning, cate. >> reporter: good morning,

frank. yeah. san francisco police are starting the new year looking for two suspects in two different shootings that injured three people. now, that first shooting happened at 10:40 last night. a victim was taken to the hospital after being shot in the hand. the suspect was described as an adult male. the shooting happened near fish finish at jefferson and mason. less than an hour later a 12- year-old boy and a man were shot near pier 23. the boy was hit in the foot and the man grazed in the hip. police say both suffered nonlife-threatening injuries. so far no arrests have been made. >> it's pretty cold. >> pretty cold is good here. it was awesome. hey, if the giants got a world series fans, i'm a huge fan. >> reporter: tens of thousands rang in the new year along the embarcadero to watch the 15- minute 5,000 fireworks show. but, of course, along with the new year's celebrations were a couple of people who couldn't

keep their celebrations in check. police made 8 arrests for public intoxication and two arrested for misdemeanor. reporting live in san francisco, cate caugiran, cbs 5. gunfire hit five people in old sacramento killing two. about 40,000 people were gathered for a fireworks show when the shots rang out in front of a restaurant on second street. the sports corner cafe. police say there was a fight at the restaurant just before the shooting. >> at first when i heard the bullets, everything was flying down there and going into stores to hide and i immediately went out because i wanted to see what the action was and then i seen the officer jump off his horse. the horse kept going. the officer just did not have no fear. he just took that guy down. >> sacramento mayor kevin johnson says that there's still no indication of any outstanding suspects. police canceled that midnight fireworks show because of it. so what's open and what's

closed on this new year's holiday? most federal, state, couldn't and city offices are all closed down today. that includes the post office and there's no mail delivery. banks are closed too. and in san francisco, you don't have to feed the parking meters today because it's a holiday. but the rest of the year i got news for you better feed the meters. >> get your quarters in tow. >> and sundays too now. >> i know. not happy about that. >> ready to say hi to lawrence? >> it's been so cold lately. i've been thinking of you. >> thank you so. i think that's a compliment. [ laughter ] >> boy. folks, around the bay area we are starting out cool but not as cold as it's going to be tonight. it's going to be a frosty night indeed. still, a couple of clouds lingering outside right now. it looks like we're in for a nice start to the new year as it is going to stay dry outside as high pressure is trying to sneak in a little bit. that means we'll see some warmer weather by this afternoon but not a lot. temperatures outside right now still cool in the valleys. 38 degrees concord.

33 and just above freezing in santa and 39 degrees in san jose. highs this afternoon about mid- 50s toward santa rosa, upper 40s to low 50s in the east bay, and about 54 degrees in san jose. we'll have more on your weather coming up in a moment. right now, let's check on the roads with gianna. >> we are still holding steady, quiet this morning. live look at the san mateo bridge. cars westbound towards foster city. right now looks like a 13, 14 minute right to go between 880 and 101. so jumping to our maps right now, let's show you 101 as you work your way along the peninsula. northbound clocking in at 61 miles per hour into san francisco. southbound no delays all the way into the south bay. 280 also looking good right now. and out of marin county so far, so good. live look at conditions at 101/580 connector. so far no delays to report. south 101 stays clear all the way towards the golden gate bridge as you work your way into san francisco. no delays to report.

mass transit heads up no ace train service today. some ferry service also canceled because of the holiday so make sure you check the schedules before you head out. but caltrain, muni and bart are all on holiday schedules. looks like bart starts around 8:00 this morning. a big takedown on some clandestine marijuana operations. this happened in part of santa clara county. sheriff's deputies dangled on a 100-foot rope suspended from a helicopter and dropped into eight separate locations. with help from state fish & game wardens, they cleared more than 4 tons of material. that included irrigation tubing, gardening equipment and a honda muffler that may have been used on a generator. it is 5:08. the new year means fewer fire stations in contra costa county. supervisors voted unanimously last month to close the stations in in clayton, lafayette, martinez and walnut creek. the move will save up to $8 million a year for the

district. the closures did not cause any layoffs but it means longer response times in those fire districts. it's going to be a community meeting to talk about the closure of the shell avenue fire station in martinez. contra costa fire chief and members of the district board all expected to answer some questions about the closure. the meeting will be january 10 at the martinez junior high school. a vigil at noon in oakland for a man who was shot and killed while detained by bart police. family members will hold the vigil at the fruitvale bart station where oscar grant was shot four years ago today. officer johannes mehserle was later found guilty on involuntary manslaughter. he was released from prison in june of 2011 after serving his sentence. in other bay area headlines, there is a ban on wood-burning today throughout the bay area. it is illegal all day to burn wood, fire logs or pellets. this order interest air quality regulators -- from ar quality

display over london making life dirtier for the revelers. workers who clean the underground are striking in a dispute over pay so london probably doesn't look so rosie this morning. back here, the roads are clear. most people walking i think there was one car going home on the road this morning at 4:30. >> the last one home from the party. couple of cars at the bay bridge. you chp says no accidents to report right now. that's good news this morning. so metering lights are off, clear into san francisco. live look at the san mateo bridge same story here, couple of cars in both directions. golden gate bridge 14 minutes from 580 into san francisco. so very quiet this morning. lots of folks probably sleeping in. as you work your way the rest of the bay area 880 off to a very nice start.

15 minutes between 238 and the maze if you are working your way northbound. traffic clear into the south bay. live look at 880ated. a few more cars on the roads but still quiet as we make the connector road there. in fact, the rest of your travel times in the south bay are in the green. 101, 280 and guadalupe parkway. highway 4, we are seeing a few brake lights westbound 4. speeds around 40 miles per hour. no major accidents or incidents there. everything clear as you work your way through 4 past antioch. once you get to the eastshore freeway, traffic is clear towards the bay bridge toll plaza. no problems in the east bay. no delays. bart, holiday schedule, muni and caltrain as well, no ace train service this morning. lawrence? >> i really wanted to ride bart last night after midnight. i didn't get a chance. i heard it's a gas. around the bay area, out

the door we have a nice day ahead. high pressure is taking over for today a couple of passing clouds this morning and temperatures not quite as cold. still chilly. we have some 30s showing up in the valleys but high pressure building in for today and it will send most of the energy from the next systems well to the north of the bay area. we'll see passing clouds throughout the next couple of days. otherwise, we are looking dry and the temperatures will stay cool. even around the state you will see numbers only in the low to mid-50s in the central valley. 53 degrees in sacramento. 55 fresno. 30s into the high country. a ton of snow up there right now if you want to get up there, roads are clear. tonight, very cold air moving in. skies will clear out. overnight lows will be dropping down into the mid- to upper 20s in the north bay valleys. the rest of the bay area cold. these clouds will continue to move on out today. lots of sunshine in the middle of the day and the afternoon. that means a decent day although the temperatures will

be cool. highs in the south bay only into the 50s this afternoon. about 54 degrees in san jose. 53 degrees in los gatos. about 52 in redwood city. east bay temperatures going to stay chilly in spots. only about 49 degrees in danville. about 50 degrees in walnut creek. 50 in concord and 51 in vallejo. as you make your way to the north bay, 56 one of the warm spots in santa rosa. 51 in san francisco. and about 52 degrees in berkeley. next couple of days, we are going to see some dry weather just a few passing clouds on thursday. looks like the next best chance of rain will come late saturday night and into sunday. that's the latest forecast, guys. back to you. >> thank you. 5:17. secretary of state hillary clinton is expected to make a full recovery. she does remain at the new york- presbyterian hospital. that's where doctors hope that blood thinners will dissolve a blood clot. it's located between her brain and skull. it's related to a concussion that she suffered last month. doctors say she will be released from the hospital once that medication dose for the

blood thinners has been established. and there's a sudden surge of marriages in maryland on this new years day as same-sex couples can now legally wed in the state. city halls in baltimore and other cities were open at midnight for those who couldn't wait. maryland is the 9th u.s. state to legalize same-sex marriage. the coast guard is working this morning to kept an oil drilling rig from running aground on the alaskan coast. the coast guard provided video of rescuers pulling workers off the rig on saturday. yesterday, oil company tugboats managed to ghetto lines tied to the rig but not so easy. they got large waves, winds gusting to 60 miles per hour. >> 35-foot waves out there. that's a little scary. a number of new state laws go into effect on this new year's day. drivers in california can now text and email while driving if and only if they use a voice operated system that's hands-

free. other laws restrict banks from pursuing so-called dual track foreclosures as well as measures to assure natural gas pipeline safety. one measure on hold is on gay conversion therapy. it won't go into effect because a federal appeals court issued a stay. here in northern california, there's also a new ordinance. san francisco's minimum wage goes up to $10.55 an hour. that's the highest in the nation. and in alameda county a reusable bag rule kicks in. single use bags will be deliberated to customers. in monterey the fee for paper bags goes from 10 cents to 25 cents. cold weather is not deterring thousands from catching out overnight in pasadena to ask your a good spot to watch the rose parade. >> cold is relative for southern california. there's a lot of fans staking out front row seats on sidewalks along the 5.5-mile parade route and a lot of them

of. >> it was like a blood letting yesterday in the nfl. dennis allen keeps his job despite only winning four games for the raiders but he made some changes. he fired greg knapp after the team averaged four fewer points than a year ago, the offensive coordinator. of allen searching for knapp's replacement. he also fired his assistant coaches for the offensive line, linebackers and special teams. so big changes for the raiders. stanford football is jacked up for this afternoon's rose bowl game against wisconsin a little after 5:00. it will be the cardinals' first rose bowl appearance since 2000. the last time they won a guy by the name of plunkett was their quarterback in 1972. but today they are 6.5-point favorites. the cardinals beat ucla for the pac-12 championship. i'm sorry, grace. cal hasn't been to the rose bowl since '59. so relax. wisconsin beat nebraska. stanford should win. play of the day from the

celebration since the long-time host passed away earlier this year. and no fog this year. it was perfectly clear night for fireworks along the waterfront here in san francisco. spectacular, it's beautiful out there. a lot of people showing up for the 15-minute display jammed the streets near the embarcadero. when it was all over, some are still working their way out of the city right now. but there was some violence during the new year's celebration. cbs 5 reporter cate caugiran is here in san francisco with the problems the police had with the new year's crowd. >> reporter: good morning, frank. last night there were two separate shootings and now three people are recovering from gunshot wounds. the first happened at 10:40 last night. a victim was shot in the hand near jefferson and mason by fisherman's wharf. police say the suspect was an adult male. the second shooting happened less than an hour later on the embarcadero past pier 23. a 12-year-old boy was shot in

shotspotter was used for the first time this new year's. the technology records the sounds and location of gunfire and sends the information directly to an officer's laptop and a patrol car. overnight police had a team of officers solely dedicated to responding to reports of gunfire. two people dead and three injured in old sacramento. they were watching fireworks when the shots rang out in front of a restaurant on second street the sports corner cafe. police say there was a fight at the restaurant just before the shooting. and an officer was able to catch a suspect. the fireworks show though was canceled. 5:35. how about a check of holiday closures? all around the bay area today, most federal, state, county and city offices closed for the billing holiday. that includes the post office, no mail delivery today. banks are closed, as well. and here in san francisco, you don't have to feed the parking meters today so you get a break heading into the city.

incidents in the roadways a stalled vehicle here and there but no major delays and no major accidents or really incidents that are blocking any lanes on any of our major freeways. here's a live look at conditions 580 as you work your way westbound headlines heading for 680 the dublin interchange. no delays eastbound. the altamont pass looks good, as well. we are going to show you your drive times for the east bay. you can see everything in the green. 580 only a 14-minute ride to go from the altamont pass to 680. 80 looking good. eastshore freeway all the way towards the maze from the carquinez bridge, and 880 and 24 not showing any delays right now. now, we're seeing a few brake lights through antioch westbound 4 about 40 miles per hour through there but nothing major going on. there is no construction to report. traffic eases up quite a bit as you work your way towards pittsburg. heading into san francisco early this morning south 101 from 580 to the golden gate bridge toll plaza only about 14 minutes. that's a look at traffic. >> thank you. 5:37. contra costa county is

sentence. the reward is up to $15,000 for any information leading to the arrest in the shooting death of a 15-year-old girl in east oakland this past weekend. investigators say jubrille jordan was shot sunday at 66th avenue and lion way as she and a 14-year-old boy were walking to the bart station. the boy is recovering from a wound to his foot. and police say the man arrested at mineta san jose international airport suffered from mental illness. the man was seen hopping a fence and running on the air field about 8:00 last into the. he ran across two runways toward a terminal. police caught him and took him into custody. in new york city, a couple there is under arrest after police say that they found bomb- making materials and a terrorist encyclopedia in their apartment. police searched the couple's greenwich village home and say they found a highly explosive white powder that is used to make bombs. they also found a sawed-off

good morning. >> reporter: absolutely. bundling up. but it is worth it this morning. 42 floats lined up and the spectators are out here just a crowd out here because this is the time where before the parade actually starts at 8:00, people can get out and get that up close and personal look at these floats. right behind me is actually the float -- the stanford float. you can see all the floral arrangements there, the will be floral arrangements. some of these floats have more than 10,000 roses on them. and actually, if you could turn to the right there's a float right behind us from glendale. i felt it was appropriate to show you folks in san francisco because there's a trolley on it. back in the day los angeles had trolleys, as well. people have been sleeping on the streets, getting one hour of our sleep, two hours of sleep. tell me about what you guys are doing before the parade

actually starts this morning. >> right now it's all about anticipation. the parade is set. we took our floats from irwindale facility which is about 11 miles away from pasadena over here last night got them in place by midnight. we have been up all night. and the floats have been here and we are getting the float riders in place and the outwalkers in place and soon they will be announcing judging at 6 a.m. so we are going to be really excited for that. >> reporter: have you been noticing things spectators are saying about some of the floats when they get to look at them so close? >> one of the crowd's favorite already is the kaiser permanente float which is actually based in oakland. they have a cat in the hat theme which is right on theme with the parade theme, oh, the places you will go, it's oh, the healthy things you can do. it's new year's resolutions. >> reporter: i saw their dance moves yesterday. >> they have some great dance
